As families go through mediation, arbitration, collaborative practice, or court processes, they often disagree on what arrangements should be made for the children. It is becoming more popular to include children in Alternative Dispute Resolution (ADR) and family court processes so that parents can hear their children's views and preferences. This is generally appropriate for children over the age of seven.

Below are two options for structured, safe, and compassionate processes to help parents understand their children's views and preferences. Neither option results in a clinical, forensic, or evaluative report. Dr. Glaholt will report only on the children's:

views and preferences
worries or concerns
perceptions and experiences

Dr. Glaholt meets with children to allow them to

participate in ADR and family court processes

via a "Hear the Child" or a "Voice of the Child" report.

Dr. Glaholt has extensive experience working with children. She worked as a Program Facilitator at Trails Youth Initiative (a charity focused on at-risk youth) for five years, and she has practiced as an Accredited Family Mediator (Ontario Association of Family Mediation) since 2017. Hayley was on the Board of the Association of Family and Conciliation Courts (Ontario) from 2018 to 2022 and her private practice is focused on parenting plans and communication. Dr. Glaholt has completed training in Non-Evaluative Child Interviewing and continues to pursue ongoing training in child-inclusive ADR practices.

What is a "Hear the Child" (HTC) Report?

As per the BC Hear the Child Society: "The Family Law Act states that when determining the best interests of a child the parties and the court must consider the child’s views unless it would be inappropriate to consider them. One way to obtain a child or youth’s views is to obtain a Hear the Child Report (“HTC Report”).

An HTC Report is a non-evaluative, verbatim report on the views of the child on issues related to family transition or family breakdown for the purpose of having the views of the child or youth considered when decisions are made about their best interest. The child has control over what is included in the report and nothing is put in the report without the child’s permission. An HTC Report does not contain any recommendations or evaluations, nor does it state the opinions or assessment of the Interviewer. It also does not opine on "the best interests" of the children. The interviewed children are not decision-makers: they have a "voice" but not a "choice". The report is prepared to help their parents, guardians, legal counsel and judges make decisions about their parenting arrangements.

A "Hear the Child" Report consists of the following and is usually completed within four weeks:

One meeting via Zoom with Parent A (30 min.); consultation with their counsel if necessary
One meeting via Zoom with Parent B (30 min.); consultation with their counsel if necessary
One interview with each child (approx. one hour)
One follow-up interview with each child (approx. 30 - 45 min.)
Dr. Glaholt completes a written report which is then shared verbally and / or electronically with the parents, ADR professional, and counsel

Note: Transportation of the child to and from the interviews is to be shared between the parents, wherever possible. Legal counsel, if involved, or a mutually agreed-to third party, may be asked to participate in making the transportation arrangements. Further, if Dr. Glaholt believes a child may be at risk, she is required to report that to the appropriate authorities.

There is a flat fee of $775.00 (+ HST) for HTC Reports, which is to be paid via e-transfer prior to the release of the Report.

The cost is generally split between the parties.

What is a "Voice of the Child" (VOC) Report?

A "Voice of the Child" Report is a more extensive version of the HTC Report. It is a way of determining a child's views and preferences in a structured, safe, compassionate manner.

An VOC Report is a non-evaluative report on the views of the child on issues related to family transition or family breakdown for the purpose of having the views of the child or youth considered when decisions are made about their best interest. The child has control over what is included in the report and nothing is put in the report without the child’s permission. An VOC Report does not contain any recommendations or evaluations, nor does it state the opinions or assessments of the Interviewer. It also does not opine on "the best interests" of the children. The interviewed children are not decision-makers: they have a "voice" but not a "choice".

The report is prepared to help their parents, guardians, legal counsel and judges make decisions about their parenting arrangements. Input from collaterals such as school teachers, CAS workers, and therapists are not requested nor are included in VOC Reports.

A "Voice of the Child" Report consists of the following and is usually completed within four weeks:

One meeting via Zoom with Parent A (one hour); consultation with their counsel if necessary
One meeting via Zoom with Parent B (one hour); consultation with their counsel if necessary
One interview with each child (approx. one hour)
One follow-up interview with each child (approx. one hour)
Dr. Glaholt completes a written report which is then shared verbally and / or electronically with the parents, ADR professional, and counsel

There is a flat fee of $1275.00 (+ HST) for HTC Reports, which is to be paid via e-transfer prior to the release of the Report.
